- Statewide only. City and county rules are often stricter, and in some states they override what is shown here.
- Federal FDA and Tobacco 21 rules apply everywhere, on top of anything below.
- Several categories are moving quickly. Directory laws, hemp rules and kratom scheduling changed repeatedly through 2026, and some are still in litigation.
What each status means
- ✓Legal. No state-specific restriction beyond the general 21+ age law. It does not mean every product is federally authorized.
- RRestricted or regulated. Legal but subject to specific state rules: licensing, potency caps, sales-channel limits, directory listing, age verification, or tax treatment.
- ✗Banned at the state level, or treated as a controlled substance outside a licensed medical or cannabis system.

Hemp-Derived Cannabinoids (THCA / THCP): THCA: restricted by Colorado's intoxicating-hemp framework and total-THC serving limits. THCP: chemically modified/converted THCP is prohibited in retail hemp products. High-potency products generally belong in the licensed cannabis channel.;
Synthetic Nicotine (e.g. Nixodine): State Nicotine Products Tax statute explicitly defines taxable nicotine as 'derived from tobacco OR created synthetically' - one of the clearer explicit inclusions of synthetic nicotine in law;
Nicotine Pouches: Legal, but regulated/taxed as nicotine products; current state excise framework applies to nicotine pouches.

The federal baseline
Everything above describes state treatment only. Regardless of state:
- The FDA regulates tobacco products containing nicotine from any source, including synthetic and non-tobacco nicotine. New products generally require premarket authorization.
- The federal minimum sales age is 21.
- A “✓” status never means a specific product has federal marketing authorization. Those are separate questions.
Scope and limits
Hemp
The hemp column covers THCA and THCP specifically. CBD, hemp Delta-9 drinks and edibles, and smokable hemp flower can be treated differently in the same state, and several states set total-THC limits rather than banning outright.
Kratom
Status refers to ordinary kratom and mitragynine. Some states regulate concentrated or synthetic 7-OH products separately.
Pouches and oral nicotine
R marks states with a confirmed rule, most often an excise-tax or licensing definition that expressly covers oral nicotine. Federal FDA authorization is required regardless of state status.
