- Federal FDA and Tobacco 21 rules apply everywhere, on top of anything below.
- Several categories are moving quickly. Directory laws, hemp rules and kratom scheduling changed repeatedly through 2026, and some are still in litigation.
What each status means
- ✓No additional statewide prohibition found for this category. It does not mean every product is federally authorized.
- RRestricted. Legal but materially regulated: flavor limits, a product directory, potency caps, licensed-channel-only sales, or specific tax and licensing rules.
- ✗Prohibited statewide, or treated as a controlled substance outside a licensed medical or cannabis system.

The federal baseline
Everything above describes state treatment only. Regardless of state:
- The FDA regulates tobacco products containing nicotine from any source, including synthetic and non-tobacco nicotine. New products generally require premarket authorization.
- The federal minimum sales age is 21.
- A “✓” status never means a specific product has federal marketing authorization. Those are separate questions.
Scope and limits
Hemp
The hemp column focuses on intoxicating and converted cannabinoids such as Delta-8. THCA flower, hemp Delta-9 drinks and edibles, CBD, and inhalable hemp can be treated differently in the same state.
Kratom
Status refers to ordinary kratom and mitragynine. Some states regulate concentrated or synthetic 7-OH products separately.
Psilocybin
R means a limited medical, decriminalized or licensed-program framework exists. It never means ordinary retail sale is permitted.
Pouches and oral nicotine
This column is deliberately conservative. R appears only where a state rule is confirmed; U means state-specific confirmation is still needed.
